Boy Arrested for Drawing Inappropriate Stick Figures by Police in Colorado, Taken Away in Handcuffs

An 11-year-old Arvada boy was arrested and taken away in handcuffs for drawing stick figures in school, something his therapist told him to do.

The boy's parents say they understand what he did was inappropriate, but are outraged by the way Arvada Police handled the case. The parents do not want their real names used.

The parents said "Tim" is being treated for Attention Deficit Disorder and his therapist told him to draw pictures when he got upset, rather than disrupt the class. So that’s what he did.

Last October, he drew stick figures of himself with a gun, pointed at four other stick figures with the words "teacher must die."

He felt calmer and was throwing the picture away when the teacher saw it and sent him to the principal's office.

The school was aware that the boy was in treatment, determined he was not a threat, notified his parents and sent him back to class. His mother, "Jane" was shocked when Arvada Police showed up at their home later that night.

She says she told her son to cooperate and tell the truth, but was horrified when they told her they were arresting him and then handcuffed him and hauled him away in a patrol car. His mother says she begged police to let her drive her son to the police department and to let her stay with him through the booking process but they refused.

They put him in a cell, took his mug shot and fingerprinted him. He says he thought he was going to jail and would never be able to go home again.

Last January, Michael Allison, a 41-year-old mechanic from Bridgeport, Illinois, went to court to protest what he saw as unfair treatment from local police officers. Allison is an auto enthusiast who likes to tinker with cars, several of which he keeps on his mother's property in the neighboring town of Robinson. Because both towns have "eyesore," or abandoned property, rules that require inoperable cars to be either registered or kept in a garage (which neither house had, and which Allison could not afford to build), Allison's cars were repeatedly impounded by local officials.

Allison sued the city of Bridgeport in 2007, arguing that the eyesore law violated his civil rights and that the city was merely trying to bilk revenues from impound fees. This apparently enraged the local police, who, Allison alleges, began harassing him at home and threatening arrest when Allison refused to get rid of his cars.

Shortly before his January 2010 court date, Allison requested a court reporter for the hearing, making it clear to the county clerk that if one was not present he would record the proceedings himself.

With the request for a court reporter denied, Allison made good on his promise to bring his own audio recorder with him to the courthouse. Here's what happened next, as reported by Radley Bilko in the latest issue of Reason magazine:

    Just after he walked through the courthouse door the next day, Allison says Crawford County Circuit Court Judge Kimbara Harrell asked him whether he had a tape recorder in his pocket. He said yes. Harrell then asked him if it was turned on. Allison said it was. Harrell then informed the defendant that he was in violation of the Illinois wiretapping law, which makes it a Class 1 felony to record someone without his consent. “You violated my right to privacy,” the judge said.


    Allison responded that he had no idea it was illegal to record public officials during the course of their work, that there was no sign or notice barring tape recorders in the courtroom, and that he brought one only because his request for a court reporter had been denied. No matter: After Harrell found him guilty of violating the car ordinance, Allison, who had no prior criminal record, was hit with five counts of wiretapping, each punishable by four to 15 years in prison. Harrell threw him in jail, setting bail at $35,000.

That's up to 75 years in prison for breaking a law Allison did not know existed, and which he violated in the name of protecting himself from what he saw as an injustice.

As Bilko points out, Allison's case may be extreme, but he is hardly alone in facing outsized punishment for efforts to combat police wrongdoing. Take Christopher Drew and Tiawanda Moore, two Chicagoans highlighted in the New York Times last week. Drew, a 60-year-old artist, faces up to 15 years in prison for using a digital video recorder during his December 2009 arrest for selling art without a permit. Drew had planned on getting arrested in protest of the permit law, which he saw as a violation of artists' rights. He was unaware that filming the ordeal was illegal.

Likewise, Moore, a 20-year-old Southside resident, did not know it was illegal to record a conversation she had with two police officers last August, and she too faces a prison sentence of up to 15 years for doing so. Moore's case is especially troubling because she was in the process of filing a complaint with the two officers about a third officer, who Moore alleges sexually harassed her in her home. She told the Times that she "was only trying to make sure no other women suffered at the hands of the officer" by making the recording. Presumably, she was also trying to protect herself in case she faced another lewd advance. Instead, the officers tried to talk her out of filing her complaint and then slapped her with eavesdropping charges when they found out her Blackberry was recording.

Phoenix police say they removed a gun from the home of actor Frankie Muniz after a domestic dispute with his girlfriend.

A police report says Elycia Turnbow claims Muniz pulled out a gun and held it against his head last Friday night after the two were arguing about prior relationships.

Turnbow told police that she was worried that the 25-year-old Muniz might be suicidal, so she called one of his band mates to take him to a hospital.

The star of the "Malcom in the Middle" TV show told police that the gun wasn't loaded. But The Arizona Republic reports officers retrieved the gun from a downstairs closet of Muniz's home and it was loaded.

Muniz's publicist says the actor wasn't arrested, wasn't suicidal and Turnbow wasn't assaulted.

Mother shot twice with a Taser after she was arrested for leaving baby in car to go to tanning salon

A woman had to be shot with a Taser twice after she was arrested for leaving her seven-month-old daughter in her car while she went to a tanning salon.

Ashley Agerenza, 19, has been charged with child abuse, resisting arrest and battery of a police officer after an incident outside Extreme Tan and Smoothies in St Petersburg, Florida.

Police said she first took the child inside the salon, but was told she could not leave the baby while she had a tanning session.

She then took the child back out to her car, strapped her into the car seat and turned on the engine, before returning to the salon.

A witness called police after seeing the baby abandoned. The responding officer found the baby had almost pushed herself out of the seat and had been sick all over herself.

When confronted, Agerenza attacked the officer and was shot twice with a Taser before being arrested.

The baby was not harmed.

A post on Agerenza's Facebook page read: 'Wit my lil mama then i might go out for the first time yay! dk if I can leave her tho...

'So maybe just a drink wen she asleep. love my baby!'

a woman has been arrested after helping herself to some of the 3,000 pounds worth of food that a Tesco Express had thrown out. Sasha Hall is said to have taken some potatoes, waffles, pies and ham that she had found on the street, following a power cut at the testco in Great baddow, Essex.

sources say she was shocked as she was approached by police and arrested for Theft by Finding. the 21 year old is now facing trial later this month.

she said of the matter. 'It had been thrown out, so i thought i could put it to better use. But when the police came round i was so upset. They made me feel like a terrible criminal.

People would believe police officers have better things to be doing with their time than going after people up potato waffles from the street. its all been blow out of proportion by offices while they waste tax payers money.
